Whilst we ensure our activities are as safe as possible unfortunately, accidents in sports do still happen from time to time. Even the most routine exercise or activity can cause injuries.

To minimize risks to participants we will ensure:

- CNCC checks on all staff are done.

- Coaches maintain relevant coaching qualifications, first aid and child protection.

- Activities, equipment and venues are checked and risk assessed prior to the start of all activities.

- Participants details are securely stored and accessible along with emergency contact information.
- We will ensure activities are age appropriate and appropriate to participants capabilities and will do our best to keep the kids safe from harm and any injuries.
- We will ensure children are supervised at all times.
- We will ensure coaches are friendly and approachable to adults and children feel confident to discuss and disclose any concerns.

1. Our Terms

The terms listed apply to a booking session with Sporty Kidz HK.

The Terms and Conditions contain important information relating to participation by you and members of your group you acknowledge and agree to all parts of the terms listed and agree to accept the Booking Terms and Conditions. No variation to the Terms and Conditions shall be valid or binding unless expressly agreed by Sporty Kidz HK.

Sporty Kidz HK reserves the right to amend any Terms and Conditions at any time.

Any person attending a session must be within the stated age range of the sessions. (under 18 MUST be signed by parent/legal guardian) During our parent and toddler sessions and sessions involving children under the age of 5, all children must be accompanied at all times with a parent/guardian.

Any costs arising from damage of any kind, willful or accidental caused by you or a member of your group will be liable to reimburse full costs to Sporty Kidz HK or the venue in which we are hiring, to rectify the damage or any losses arising from that damage.

Sporty Kidz HK does not accept any claims or responsibility for the loss of property, damage to property or theft whilst attending our sessions, but we do advise that all items of property are clearly labelled for the best chance for us to return to the rightful owner. Valuables and/or money should not be left unattended.

2. Booking Confirmations:

All bookings will only be considered valid and final when confirmed and payment in full has been received.

Sporty Kidz HK shall use all reasonable efforts to ensure that you and your parties participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals may not be permitted to undertake the activities and no refunds or compensation will be payable in such circumstances.

3. Cancellations & Make-up Policy

Upon announcement of Tropical Cyclone Warning Signal No. 8 or above, or Black Rainstorm Warning, pre-warning thereof, all classes will be cancelled or postponed.

All Outdoor Activities will be postponed or cancelled upon announcement of Tropical Cyclone Warning Signal No.3 or above, and Red or Black Rainstorm Signal

Participants will be advised of re-scheduled classes due to bad weather as soon as possible. No fees will be refunded.

If a student is not able to attend a class due to personal reasons, the parent/guardian must inform Sporty Kidz HK as soon as possible. If the parent/guardian has confirmed attendance of the child and do not attend the class, you will be marked as attended and no refund or make-up class will be allowed. If you have purchased a package of 5 classes, a total of 2 classes are allowed to be missed, unless a valid reason or doctors letter has been provided.

Sporty Kidz HK reserves the right to cancel any bookings for any reason without consultation with the person or party making the booking. We (Sporty Kidz HK) will make all reasonable attempts to contact you as soon as is possible.

Prices and Payment:

All activities with Sporty Kidz HK require full payment to attend a class.

Our fee structure is as follows:

Trial Lesson is free of charge. If you sign your child up for a free trial lesson and do not attend you will be charged a penalty fee of HK$200, which would be separate from the drop in fee or the package fee.

Drop in fee is HK$250. This is a pay as you go option. If you feel that your child would only be able to attend at very infrequent times.

Package fee is HK$1000. This will be for a total of 5 classes. If a package is purchased we highly recommend that you bring your child to attend all 5 classes in a row. This is beneficial to your child's development in the lesson he/she participates in. Please refer to point 3. (Cancellation & Make-up Policy.)

The fees paid for the class accumulates towards a 1 hour (60min.) lesson. All classes, unless for any unforeseen circumstance that arise during the lesson will have a duration of 1 hour (60min) long. If the class is shorter than 1 hour no refund will be given due to the unexpected reason that occurred during the class.

1. Waiver:

Child(ren) of the parent/guardian are not permitted to participate in activities without reading and agreeing to the following waiver.

Acknowledgment and Assumption of Risk:

I am fully aware of the inherent dangers and risks, to my person/my child with the activities my child participates in offered by Sporty Kidz HK.

Where children under the age of 18 are participating- I declare that I am the parent or legal guardian of the child or I have authority from the child’s parent or legal guardian to sign this Waiver Form.

I agree that I/the child will wear sports appropriate clothing throughout activities.

I confirm that I/ the child is in good physical condition and has no medical impairment that might prevent him/her from such activities.

I confirm that I have disclosed all medical/physical information that may impact my understanding or ability to make appropriate adaptions to ensure activities are both safe and inclusive.

I acknowledge that the Activity is potentially dangerous and that by participating in the Activity I/the child will be exposed to the possibility of personal injury.

Nevertheless, I voluntarily elect to participate/allow my child to participate in the activities with full knowledge and awareness of the possible injuries involved. I hereby agree to accept and assume any and all risks of personal injury.

2. Waiver of Liability and Indemnification

I understand it is my responsibility to ensure Sporty Kidz HK have up to date information regarding I/my child medical information, emergency contact information and I am to update Sporty Kidz HK if any of my information should change.

3. Use of Image and Likeness

I understand that I/my child may be photographed and filmed during the activity. Photos/videos will be used for marketing purposes to promote sports classes to those interested in joining.

I HAVE FULLY READ AND UNDERSTAND OF THE CONTENTS OF THIS AGREEMENT BEFORE SIGNING IT. AND, THAT NO ORAL REPRESENTATIONS, STATEMENTS, OR OTHER INDUCEMENTS TO SIGN THIS RELEASE HAVE BEEN MADE APART FROM WHAT IS CONTAINED IN THIS DOCUMENT. I ALSO UNDERSTAND THIS CONTRACT AFFECTS MY LEGAL RIGHTS, AND HEREBY SIGNS IT ON MY OWN FREE WILL. IF THE ATTENDEE IS A MINOR, THE PARENT OR A RESPONSIBLE ADULT MUST SIGN THIS FORM.
